Settlement reached in $312 million AFFF contamination case for public water systems
(UI) — Angeion Group announced a settlement with BASF Corporation in a class action lawsuit involving all active public water systems in the United States with impacted water sources as of May 15, 2024. The $312.5 million settlement addresses contamination from aqueous film-forming foams (AFFF).
The settlement covers public water systems with a qualifying test result showing measurable PFAS concentration. These systems include any collection, treatment, storage, and distribution facilities under the operator's control and used primarily in connection with such systems.
BASF will pay an additional $4 million to cover costs incurred by the notice administrator, bringing the total settlement amount to $316.5 million. Eligible class members will receive settlement checks based on allocation procedures developed by class counsel and approved by the court.
Eligible claimants must file a claims form online or by mail within 60 days after the settlement's effective date. Those who meet the settlement class definition and do not opt-out will be bound by the settlement and precluded from pursuing separate claims against BASF.
Claimants can opt-out by submitting a Request for Exclusion form by October 15, 2024. Those who wish to object to the settlement must file a written statement by September 15, 2024.
The court's final fairness hearing is scheduled for November 1, 2024, in Charleston, South Carolina. The hearing will determine the settlement's final approval, the dismissal of released claims, class certification, and any attorneys' fees and costs to be awarded.
